    Sell a House in Foreclosure

If you are behind on your mortgage, the most important thing to know is this: the house is still yours, and you can still sell it, right up until the foreclosure sale actually happens. Being in foreclosure does not take away your right to sell.

How much time you have depends on which state the house is in, and the difference is large. Indiana and Tennessee foreclose in genuinely different ways, so read the note for your state below before you decide anything.

It works differently in each state

Read the one your house is in. The difference changes how much time you have.

    Indiana

Indiana forecloses through the courts. Your lender has to file a lawsuit, get a judgment from a judge, and only then can the property be sold at a sheriff's sale. That process takes months, not days, and every one of those months is time you can use to sell on your own terms instead of having the sale happen to you. The date to watch is the sheriff's sale date.

    Tennessee

Tennessee is different, and the difference matters. Most Tennessee mortgages are written as a deed of trust with a power of sale, which lets the lender foreclose without going to court. A trustee gives the required notice, publishes it, and can hold the sale weeks later rather than months. If you are in Tennessee and you have received a notice of substitute trustee's sale, treat it as urgent and call us the same day — there is usually still room to sell, but much less of it than an Indiana seller has.

    What your options are

Selling to us is one of them, and it is not always the right one. Here is the honest version.

Reinstate or work it out with the lender

If the shortfall is small and your income has recovered, catching up the arrears or negotiating a repayment plan or modification keeps the house. This is the best outcome when it is realistic, and it costs you nothing to ask your servicer for a loss-mitigation review.

    List it on the market

If you have real equity and several months before the sale, a traditional listing can net you the most money. The risk is timing: a listing can sit, a buyer's financing can fall through, and a failed closing puts you back on the foreclosure clock with less time than you started with.

Sell for cash before the sale date

A cash sale trades some price for certainty and speed. There is no lender on our side to approve anything, no appraisal to come in low, and no repair demands. If the sale date is close, or the house needs work you cannot pay for, this is usually the option that actually finishes.

    Short sale

If you owe more than the house is worth, the lender has to agree to accept less than the balance. It can work, but it runs on the lender's timetable and that is rarely fast. Worth exploring early, not three weeks before a sale date.

How selling to HudREI works here

    1. 1

Tell us the address, roughly what is owed, and whether a sale date has been set. The sale date is the detail that changes everything, so tell us even if you are not sure.

    2. 2

We pull the county records ourselves and make you a cash offer. You do not need to clean, repair, or show the house to anyone.

    3. 3

If you accept, we work directly with your lender's payoff department and a local title company. Where a sale date is already set, title coordinates the payoff against that date.

    4. 4

At closing the mortgage is paid from the proceeds. If there is money left over after the payoff and costs, that money is yours.

    How long it takes

Cash closings usually land in two to three weeks, and we can move faster when a sale date forces it. The limit is almost always the title work and the lender's payoff letter, not us. If your sale date is close, say so on the first call — especially in Tennessee, where the sale can arrive much sooner than sellers expect.

    Questions sellers actually ask

Can I sell my house if it is already in foreclosure?+

Yes. You own the property until the foreclosure sale is completed — a sheriff's sale in Indiana, a trustee's sale in Tennessee — and you can sell it up to that point. The mortgage gets paid off from the sale proceeds at closing, which is what stops the foreclosure.

Will selling stop the foreclosure sale?+

A completed sale pays off the debt, which is what ends the foreclosure. Your sale has to actually close before the auction date, so the earlier you start, the more room there is. Tell us the date and we will tell you honestly whether it is achievable rather than tie up your house while the clock runs.

What if I owe more than the house is worth?+

Then a straight sale will not cover the balance, and you are looking at a short sale, which your lender has to approve. We can still look at it, but we will tell you plainly if we do not think it works rather than tie your house up while the clock runs.

Do I get any money if I sell during foreclosure?+

If the sale price covers the payoff and closing costs, whatever is left is yours. That is the main reason to sell rather than let the auction happen: at a foreclosure auction you have no say in the price.

Will this wreck my credit either way?+

A completed foreclosure is one of the heavier marks on a credit report. Selling before it completes means the loan shows as paid rather than foreclosed. We cannot promise what any particular bureau will show, but the two outcomes are not the same.

How much does it cost me to sell to you?+

Nothing out of pocket. No commission, no repairs, and we cover standard closing costs. The number we agree on is what the payoff and your proceeds come out of.

We buy houses; we are not attorneys or tax advisers. Nothing here is legal advice, and on anything involving a court, an estate, or the county, you should talk to a professional about your own situation.

    Where we buy

We buy across Indiana and Tennessee. These are some of the areas where this comes up most.

Imagine handing over the keys and never looking back.
